ALL DAY CANNABIS DELIVERY — TERMS OF SERVICE

1. ACCEPTANCE OF TERMS
By accessing or using the All Day Delivery website, placing an order, or receiving delivery services, you agree to be bound by these Terms of Service and all applicable Nevada state laws and regulations governing cannabis. If you do not agree to these terms, do not use this service.
2. ELIGIBILITY
To use All Day Delivery you must:
- Be 21 years of age or older, or a valid Nevada medical cannabis patient with a current registry identification card
- Be a Nevada resident receiving delivery within our approved service area
- Possess a valid government-issued photo ID
- Not be prohibited by any federal, state, or local law from purchasing or possessing cannabis
We reserve the right to refuse service to any person who cannot verify eligibility at the time of delivery. Orders placed by ineligible individuals will be cancelled. No refund will be issued for orders cancelled due to eligibility failure at delivery.
3. AGE VERIFICATION
All Day Delivery is strictly a 21+ service. Age verification is required at two points:
At order placement — you confirm your age digitally by entering the site and placing an order.
At delivery — a valid government-issued photo ID must be presented to the delivery driver at the time of delivery. Acceptable forms of ID include a US driver’s license, state-issued ID card, US passport, or military ID. Expired IDs will not be accepted. Delivery will be refused if valid ID cannot be produced. No refund will be issued for refused deliveries due to failed ID verification.
4. SERVICE AREA
All Day Delivery operates within a [15]-mile delivery radius from 11527 Nu-Wav Kaiv Blvd, Las Vegas, NV 89124. Delivery availability is determined at checkout by address verification. We reserve the right to modify our service area at any time. Orders placed outside the service area will be cancelled and refunded.
5. ORDERS
5.1 Order Placement Orders are placed through our online menu powered by Hytiva. By placing an order you confirm that all information provided is accurate and that you meet the eligibility requirements in Section 2.
5.2 Order Minimums A minimum order of $50 is required. Free delivery is included on every qualifying order of $50 or more. Orders below $50 are not accepted.delivery.
5.3 Order Confirmation Order confirmation is sent by text message to the phone number provided at checkout. Your order is not confirmed until you receive this confirmation.
5.4 Order Modifications Orders cannot be modified after confirmation. If you need to cancel an order, contact us immediately at 725.777.1091. Cancellations are only possible before the order has been dispatched for delivery.
5.5 Order Limits All orders are subject to Nevada Cannabis Compliance Board purchase limits. Please refer to the Nevada Cannabis Compliance Board Possession and Consumption Regulation.
6. PRICING AND PAYMENT
6.1 Pricing All prices displayed on the All Day Delivery menu include applicable Nevada cannabis excise tax and sales tax. The price shown is the price you pay. No additional taxes will be added at checkout.
6.2 Price Consistency All Day Delivery operates on a consistent daily markup. Prices do not change based on the day, time, or promotional calendar. The price displayed at the time of order placement is the price charged.
6.3 Payment Accepted payment methods: We accept CanPay or equivalent cashless payment rails. Payment is due at the time of delivery.
6.4 Pricing Errors In the event of a pricing error on our menu, All Day Delivery reserves the right to cancel the affected order and issue a full refund.
7. DELIVERY
7.1 Delivery Hours Current delivery hours are posted on alldayofficial.com and may vary based on operational status. Orders placed outside active delivery hours will be processed during the next available delivery window.
7.2 Delivery Windows Estimated delivery windows are provided at the time of order confirmation by text. Delivery times are estimates only and are not guaranteed. All Day Delivery is not liable for delays caused by traffic, weather, or circumstances outside our control.
7.3 Delivery Location Delivery is made to the address specified at checkout. Delivery to public places, parks, schools, or locations prohibited by Nevada law is not permitted. We reserve the right to refuse delivery to any location we determine to be unsafe or non-compliant.
7.4 Recipient Requirements The person receiving the delivery must be the person who placed the order, or an authorized adult recipient 21 years or older residing at the delivery address. The recipient must present valid ID at delivery.
7.5 Failed Deliveries If delivery cannot be completed because no eligible adult is present, the order will be returned and cancelled. No refund will be issued for failed deliveries due to recipient unavailability.
7.6 Free Delivery Free delivery is available on qualifying orders of $50 or more. A minimum order of $50 is required. Orders below $50 are not accepted.
8. RETURNS AND REFUNDS
8.1 Cannabis Products Due to Nevada state regulations, cannabis products cannot be returned once delivered. All sales are final.
8.2 Damaged or Incorrect Orders If you receive damaged, incorrect, or missing items, contact us within [24 hours] of delivery at info@alldayofficial or 725.777.1091. We will review each situation on a case-by-case basis and may offer a replacement, store credit, or refund at our discretion.
8.3 Cancelled Orders Orders cancelled before dispatch will be refunded in full. Orders cancelled after dispatch or refused at delivery are not eligible for refund.
9. WELCOME OFFER AND REFERRAL PROGRAM
9.1 Welcome Offer New customers who place a qualifying first order of $50 or more may select one complimentary item from the All Day welcome selection, up to $25 in value. A second complimentary item of equal value is available on the customer’s second qualifying order of $50 or more. The welcome offer is available to new All Day customers only, limit once per household. Items are selected from a curated selection determined by All Day Delivery. Selection is subject to availability and may change without notice.
9.2 Referral Program Existing All Day customers may refer new customers using a unique referral link. When a referred customer places their first qualifying order of $50 or more, the referring customer receives one complimentary item from the referral selection on their next order. There is no cap on the number of referrals a customer may make. Referral rewards are non-transferable, have no cash value, and may not be combined with other offers. All Day Delivery reserves the right to modify or discontinue the referral program at any time without notice.
9.3 Offer Abuse All Day Delivery reserves the right to cancel orders, void rewards, and terminate accounts where offer abuse, fraud, or manipulation is suspected.
10. PROHIBITED CONDUCT
You agree not to:
- Purchase cannabis for resale or distribution to a third party
- Provide false information during age or identity verification
- Resell, transfer, or gift cannabis products obtained through All Day Delivery in violation of Nevada law
- Use this service for any unlawful purpose
- Attempt to place orders on behalf of a person under 21
- Circumvent or manipulate the ordering, pricing, or verification systems
Violation of any prohibited conduct may result in immediate account termination and reporting to applicable Nevada regulatory authorities.
11. COMPLIANCE WITH NEVADA LAW
All Day Delivery operates under Nevada state cannabis law and is licensed by the Nevada Cannabis Compliance Board under License No. [YOUR LICENSE NUMBER]. All transactions are conducted in compliance with Nevada Revised Statutes Chapter 678B and applicable regulations. Cannabis purchased through All Day Delivery is for personal use only and may not be transported across state lines. Cannabis remains illegal under federal law.
12. INTELLECTUAL PROPERTY
All content on the All Day Delivery website — including text, graphics, logos, and design — is the property of All Day Delivery and may not be reproduced, distributed, or used without written permission.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by Nevada law, All Day Delivery and its officers, employees, and agents are not liable for any indirect, incidental, or consequential damages arising from your use of this service. Our total liability for any claim arising from a transaction is limited to the value of that transaction.
14. INDEMNIFICATION
You agree to indemnify and hold harmless All Day Delivery, its officers, employees, and agents from any claims, damages, or expenses arising from your use of this service or your violation of these Terms.
15. PRIVACY
Your use of All Day Delivery is also governed by our Privacy Policy, available at Privacy Policy. By using this service you consent to the collection and use of your information as described in the Privacy Policy.
16. CHANGES TO TERMS
All Day Delivery reserves the right to modify these Terms of Service at any time. Changes are effective upon posting to the website. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.
17. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws and ordinances of the Las Vegas Paiute Tribe. Any disputes arising from these Terms or your use of All Day Delivery shall be resolved exclusively within the Las Vegas Paiute Tribal Courts, located on the Las Vegas Paiute Tribal lands.
